General Terms and Conditions – Happy Canoe


1. Definitions

Lessor: Happy Canoe, located at Van Ennettenstraat 27, 5643 MC Eindhoven, registered with the Chamber of Commerce under number 84986875.

Tenant: The natural person or legal entity who enters into an agreement with the landlord.

Equipment: All rented equipment, including canoes, paddles, life jackets and other accessories.


2. Applicability

These general terms and conditions apply to all agreements between Happy Canoe and renters regarding the renting of canoes and related materials. Deviations only apply if agreed in writing.


3. Reservation & payment

Reservations can be made online, by phone or on site.

Payment is made in advance, unless otherwise agreed.

In case of cancellation up to 48 hours in advance, 50% of the rental amount will be charged; in case of cancellation within 48 hours, the full amount is due.


4. Use of the canoe

The renter and his/her party declare that they are able to handle a canoe safely.

It is forbidden to sail under the influence of alcohol or drugs.

Intentional damage or unnecessary wear and tear to material will be charged.

Getting on and off is only permitted at the designated locations, which can be recognised by the water board sign below:


5. Safety & behaviour

Always follow sailing regulations and instructions from personnel or competent authorities.

Life jackets are mandatory for children under 6 years of age or without a swimming diploma A.

There must be at least one supervisor per group who is at least 18 years old.

You must take your own waste with you.

Shouting and use of speakers is not allowed.

In case of misconduct, staff may immediately remove participants from the canoe or from the premises without the right to a refund.


6. Liability

Use of canoes is entirely at your own risk.

Happy Canoe is not liable for any damage, injury or loss unless there is intent or gross negligence.

Tenant is liable for damage or loss of materials, regardless of the cause.

The tenant indemnifies Happy Canoe against claims from third parties regarding damage during the rental.


7. Return of material

The material must be returned clean and at the agreed time.

Late returns or missing materials may result in additional charges or a replacement request.


8. Force Majeure

In the event of force majeure (such as extreme weather, technical failures, calamities), Happy Canoe may cancel or move the agreement without compensation.


9. Media & privacy

It is prohibited to take photos or videos of staff or unknown persons in or around the water without permission.

Such footage must be removed upon request.

Detailed recordings of material are not permitted without written permission.


10. Intellectual property

All designs, images and communications of Happy Canoe remain the property of the company. Use, distribution or reproduction is only permitted with written permission.


11. Complaints & damages

Any complaints must be reported immediately to an employee.

Complaints that could not be resolved on site must be submitted in writing within 7 days of the activity.

Claims outside this period may be rejected.


12. Applicable law

These terms and conditions are governed by Dutch law. Disputes will be handled exclusively by the competent court in the district where Happy Canoe is established.
